Scumware: A
New Threat

As if the falling
tech stock market and resulting failure of hundreds of
high-profile dot-coms weren't enough, now comes word of a
new scourge: scumware.
Scumware refers to programs that overlay text links from
advertisers on your Web site without your permission.
Some organizations, such as
Microsoft, believe that scumware will benefit consumers by
allowing them to click on virtually any word on any Web
site to read related content on or off that site.
Scourge, Not Solution
In theory, that
sounds great. In practice, scumware poses a grave threat
to publishers, advertisers and other users of the
Internet.
Microsoft had planned to include
SmartTags in the next version of its operating system,
Windows XP. I am no enemy of Microsoft and look forward to
its new operating system, especially because it relented
to public pressure and agreed to remove SmartTags from
Windows XP.
Although SmartTags now present no
immediate worry, other products already on the market do
essentially the same thing.
TopText, which is made by
eZula, is hidden in
a Napsterlike file-sharing tool called KaZaa. According to
CNET's Download.com, almost 8 million people have
downloaded KaZaa. When they start to use it, TopText
modifies their browsers.
The result? When they visit your
Web site, TopText modifies your Web page without your
permission by highlighting in yellow all the keywords
eZula has sold. Advertisers pay per click for the
keywords. How much of that advertising revenue does eZula
plan to share with you? Not a penny.
Altered Status
When eZula alters
your Web site without your permission, it can have
detrimental effects for you. One is loss of your visitors
to your competition, after they click on any of the dozens
or hundreds of hyperlinks eZula adds to each page of your
site. Another is loss of sales when your customers are
diverted to other sites. And still another is loss of
commissions when your visitors are diverted to other sites
before they have the chance to click on your affiliate
links.
For those who aren't convinced
about the magnitude of the threat posed by scumware, let's
walk through a few examples.

Suppose a job-seeking
college student went to CollegeRecruiter.com to search our job
openings and post a resume to our resume bank. Because KaZaa has
been downloaded and installed, the student's browser has been
modified by TopText and many of the words on our home page and
the other 600 pages on our site appear as hyperlinks. The word
resume is hyperlinked and the student clicks on it.
The result? The student is
taken to our competitor's Web site because the competitor
purchased the word resume from eZula, the maker of KaZaa and
TopText.
How about another example?
The same student is drinking a can of Pepsi and sees some text
on the can that urges a visit to Pepsiworld, Pepsi's Web site.
On the home page, the word cola is hyperlinked. A click on it
and the student is taken to a competitor of Pepsi. The result?
Pepsi, against its will, has driven traffic and possibly a new
customer to its competitor.
Now, how about something
dangerous? Suppose your 12-year-old is using the U.S.
government's National Institutes of Health Web site to help her
with a research paper on breast cancer. She notices the word
breast is hyperlinked, clicks on it, and is taken to a Web site
run by a pedophile. Scary? You bet.
Scumware, although a
technical innovation, is one I can definitely do without. As
outlined by
Sunil Tanna,
self-proclaimed marketing geek, we should stand against scumware
using the following legal and ethical means.
Don't
install eZula or other scumware onto your computer. To
remove it, go to
WhirlyWiryWeb.com.
Exert pressure
on companies that manufacture, advertise through, or promote
scumware. Companies that manufacture scumware include eZula,
Microsoft and Surf+. Companies that promote scumware include
BeFree, which manages the Gator.com affiliate program, and CNET,
which runs Download.com.
Discuss
with an intellectual property attorney the possibility of suing
one or more of the companies that manufacture or promote
scumware.
Modify
your Web site content so that you do not use keywords that have
been purchased by companies using scumware as an advertising
vehicle.
Contact
your local and national elected officials and governmental
agencies to complain.
Educate
everyone you know who uses the Internet about this issue.
